3. Service Availability

8. Limitation of Liability

Our total liability for any claim will not exceed the amount you paid us for the Services in the six (6) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless rx.co and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

10. Dispute Resolution and Arbitration

   These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

2. Arbitration

   Any dispute arising from or relating to these Terms or your use of our Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Delaware, unless otherwise agreed. You waive any right to a jury trial or to participate in a class action lawsuit or arbitration. The arbitrator's decision will be final and binding, subject to limited judicial review.

   You or rx.co may pursue claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property violations or other urgent matters.

11. Termination

We may suspend or terminate your access to our Services at our discretion, including for violation of these Terms, fraudulent activity, or legal requirements. Upon termination, your right to use our Services ceases, but these Terms' provisions (e.g., disclaimers, liability limits, arbitration) survive.
